Visit San Antonio Twitter Ticket Giveaway Rules

NO PURCHASE NECESSARY TO RECEIVE TICKETS. A PURCHASE WILL NOT IMPROVE YOUR CHANCES OF RECEIVING TICKETS. Tickets are awarded on a first come, first served basis. Void where prohibited or otherwise restricted by law.

ELIGIBILITY: The Visit San Antonio (“Sponsor”) “San Antonio Ticket Giveaway” (“Giveaway“) is open only to persons who, as of date of entry, are legal residents of one of the fifty (50) United States or the District of Columbia, and at least 18 years of age (“Entrant”) . Employees and retirees of Sponsor and either promotional agencies (including their immediate families and persons living in their households) are not eligible to enter. “Immediate family members” means parents, spouses, children, siblings, in-laws, or grandparents. All federal, state and local laws and regulations apply

HOW TO GET TICKETS:  From September 1, 2019 through August 31, 2019 (“Giveaway Period”), the Sponsor may periodically disclose a Ticket Giveaway on its Twitter accounts (@visitsanantonio, @saveinsa and @meetinsa). The first Twitter user who retweets Sponsor’s Ticket Giveaway Tweet will be eligible to receive the tickets (the “Ticket Recipient”). The Ticket Recipient will be contacted by Tweet and will be given instructions to pick up the tickets within a specified time frame. Tickets which are not picked up within the specified time frame will be forfeited and will not be re-awarded. If you do not have a Twitter account, visit www.twitter.com to create one for free. Each account can only be entered one (1) time per Giveaway. LIMIT: One (1) prize per person or household only during the giveaway period. Tickets must be picked up by the Ticket Recipient with proof of identity (driver’s license or passport) at the San Antonio Visitors Information Center (“VIC”), 317 Alamo Plaza, San Antonio, TX  78205, between the hours of 9:00 a.m. and 5:00 p.m. CST, 7 days a week, other than national holidays.

All entrants must have a valid Public Twitter account used via a mobile device or on the Internet. Twitter is free to join as of the time of publication of these Official Rules. If you use Twitter from your mobile device, your wireless service provider may charge you for each text message you send and receive. Please consult your wireless service provider regarding its pricing plans. This Giveaway is not sponsored, endorsed or administered by, or associated with Twitter.

TICKETS:  The Ticket Recipient will be given tickets to the disclosed event (the “Event”), subject to availability by Event sponsor. Sponsor is not responsible if the event is delayed, postponed or cancelled for any reason and winner will not be reimbursed for tickets. Seating to be determined in the sole discretion of the Sponsor. By accepting ticket prize, winner agrees to abide by any terms, conditions and restrictions provided by the ticket. Tickets must be picked up at the VIC and will not be mailed. Any tickets not picked up within four (4) weeks of the Giveaway will be forfeited. Events are attended at the risk of the Ticket Recipient and his/her guests.

NOTIFICATION:  Ticket Recipients will be notified by a Direct Message Tweet asking the Ticket Recipients to private message the Sponsor. If any potential Ticket Recipient does not respond within five (5) calendar days of the Direct Message notification, the tickets will be forfeited and will not be awarded. Upon prize forfeiture, no compensation will be given. Limit one (1) prize per person or household or Twitter account.

CONDITIONS:  Participation in the Giveaway constitutes each Ticket Recipient’s permission for Sponsor to use his/her name, Twitter account tag, address (city and state) and photograph (including Twitter profile photo) for advertising and promotional purposes, in any and all media now known or hereafter developed, worldwide, in perpetuity, without notice or additional compensation, except where prohibited by law. By participating, each Ticket Recipient agrees to release, indemnify and hold harmless Sponsor, its affiliates, partners and promotion and advertising agencies, Twitter, Inc. and each of their respective parent companies, subsidiaries, affiliates, partners, representatives, agents, successors, assigns, employees, officers and directors (collectively, the “Released Entities”), from any and all liability, for loss, harm, damage, injury, cost or expense whatsoever including without limitation, property damage, personal injury and/or death which may occur in connection with travel to or attendance of the Event and for any claims based on copyright, trademark, false endorsement, publicity rights, defamation and invasion of privacy. Sponsor is not responsible if the Event cannot take place for any reason. Ticket Recipients who do not comply with these Official Rules in any way shall be disqualified.

ADDITIONAL CONDITIONS: In case of dispute as to the identity of the Ticket Recipient, the Ticket Recipient will be declared made by the authorized account holder of the email address associated with the Twitter account used. “Authorized Account Holder” is defined as the natural person who is assigned an email address by an Internet access provider, online service provider, or other organization (e.g., business, educational, institution, etc.) responsible for assigning email addresses for the domain associated with the submitted email address. The Released Entities are not responsible for technical, hardware, software, telephone or other communications malfunctions, errors or failures of any kind, lost or unavailable network connections, website or Internet availability, unauthorized human intervention, traffic congestion, incomplete or inaccurate capture of entry information (regardless of cause) or failed, incomplete, garbled, jumbled or delayed computer transmissions which may limit one’s ability to participate in the Giveaway, including any injury or damage to any person’s computer relating to or resulting from participating in the Giveaway. Sponsor reserves the right, in its sole discretion, to cancel, terminate, modify, extend or suspend the Giveaway for any reason whatsoever, and to disqualify any person in its sole discretion.

CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE GIVEAWAY MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.

LIMITATION OF LIABILITY; DISCLAIMER OF WARRANTEES: IN NO EVENT WILL THE RELEASED ENTITIES BE RESPONSIBLE OR LIABLE FOR ANY DAMAGES OR LOSSES OF ANY KIND, INCLUDING DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES ARISING OUT OF YOUR ACCESS TO AND USE OF TWITTER, ATTENDANCE OF THE EVENT AND/OR PARTICIPATION IN THE GIVEAWAY. IN NO EVENT SHALL THE RELEASED ENTITIES’ TOTAL LIABILITY TO YOU FOR ALL DAMAGES, LOSSES, OR CAUSES OF ACTION EXCEED $10. WITHOUT LIMITING THE FOREGOING, THE TICKETS TO THE EVENT ARE PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED.

ARBITRATION/CHOICE OF LAW: Except where prohibited by law, participants agree that any and all disputes, claims and causes of action arising out of or connected with this Giveaway shall be resolved exclusively by arbitration pursuant to the rules of the American Arbitration Association then effective, and any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred by participants with regard to this Giveaway, excluding all attorneys’ or other related fees and punitive, incidental, consequential or other damages, and without resort to any class action. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules shall be governed by and construed in accordance with the laws of the State of Texas, without giving effect to any choice of law or conflict of law rules or provisions (whether of the State of Texas or any other jurisdiction) that would cause the application of the laws of any jurisdiction other than the State of Texas. The arbitration shall be conducted in Bexar County, Texas. The invalidity or unenforceability of any provision of these Official Rules shall not affect the validity or enforceability of any other provision so long as the general intent of these Official Rules remains in effect. In the event that any such provision is determined to be invalid or otherwise unenforceable, these Official Rules shall be construed in accordance with their terms as if the invalid or unenforceable provision was not contained therein.
